An order of use of wild plants and wild animals listed in the Red Book is changing

According to the document, additions and amendments were made to the Law "On Nature Protection" of December 9, 1992, the Code of the Republic of Uzbekistan on Administrative Responsibility of September 22, 1994, the Law "On the Protection and Use of Flora" of December 26, 1997, the Law "On the Protection and Use of Wildlife" of December 26, 1997 G., the Law "On Protected Natural Territories" of December 3, 2004, and the Law "On Hunting and Hunting Economy" of July 8, 2020.
In particular, the following amendments have been made to the Law "On the Protection and Use of Flora":
Article 17:
— In order to preserve and protect rare and endangered species of wild plants, protected natural areas can be created in places where their growing environment is located.
Article 31 has been supplemented by parts two, three, and four as follows:
– Rare and endangered species of wild plants listed in the Red Book of the Republic of Uzbekistan can be used with removal from the natural environment in order to conduct research on the conservation, protection, reproduction, and restoration of these plant species. It is prohibited to collect seeds or harvest seeds, seedlings, and sprouts of rare and endangered species of wild plants listed in the Red Book of the Republic of Uzbekistan grown in nurseries and plantations earlier than three years after planting in the natural environment.
— In relation to certain rare and endangered species of wild plants listed in the Red Book of the Republic of Uzbekistan and their parts, the issuance of permits for removal from the natural environment may be limited. The grounds, types of wild plants and their parts, the validity period of restrictions on the removal from the natural environment of rare and endangered species of wild plants and their parts are determined by the Cabinet of Ministers of the Republic of Uzbekistan on the basis of proposals submitted by the Ministry of Ecology, Environmental Protection and Climate Change of the Republic of Uzbekistan, taking into account the conclusion of the Academy of Sciences.
The following amendments have been made to the third part of Article 37 of the Law:
— Felling of trees and shrubs that are not part of the state forest fund, damaged as a result of exposure to natural factors or pests, plant diseases, drying up or dried up, as well as threatening the safety of human life and health, property of legal entities and individuals, is carried out without payment on the basis of permits issued by the Ministry of Ecology, Environmental Protection and climate change in the Republic of Karakalpakstan, the departments of the regions and the city of Tashkent of the Ministry of Ecology, Environmental Protection and Climate Change of the Republic of Uzbekistan.
Text of article 42 of this Law has been amended as follows:
- Relocation to other places, as well as hybridization of wild plants, are allowed in accordance with the established procedure for scientific and economic purposes by decision of the Ministry of Ecology, Environmental Protection and Climate Change of the Republic of Uzbekistan, taking into account the conclusion of the Academy of Sciences.
The following amendments and additions have been made to the Law "On the Protection and Use of Wildlife":
Part One of Article 19:
— The removal of rare and endangered species of wild animals from the natural habitat is allowed under a permit issued by the Ministry of Ecology, Environmental Protection, and Climate Change of the Republic of Uzbekistan, taking into account the conclusion of the Academy of Sciences of the Republic of Uzbekistan and based on the decision of the Cabinet of Ministers of the Republic of Uzbekistan in the following cases:
– in order to breed them in specially created conditions and then settle them in their natural habitat;
– for carrying out scientific and control work;
– in cases of special need in accordance with the legislation";
Article 19 has been supplemented by Part two as follows:
— In relation to certain rare and endangered species of wild animals listed in the Red Book of the Republic of Uzbekistan, the issuance of permits for removal from the natural habitat may be limited. The grounds, types of animals, and duration of restrictions on the removal of rare and endangered species of wild animals from the natural habitat are determined by the Cabinet of Ministers of the Republic of Uzbekistan on the basis of proposals submitted by the Ministry of Ecology, Environmental Protection, and Climate Change of the Republic of Uzbekistan, taking into account the conclusion of the Academy of Sciences of the Republic of Uzbekistan.
The fourth part of Article 29 has been amended as follows:
— Permission for special use of wildlife objects is issued by the Ministry of Ecology, Environmental Protection, and Climate Change of the Republic of Uzbekistan within the approved quotas for the extraction of wild animals. Quotas for the extraction of wild animals are approved by the Ministry of Ecology, Environmental Protection, and Climate Change of the Republic of Uzbekistan on the basis of data from the state accounting of wildlife objects and accounting for their use, the conclusion of the Academy of Sciences of the Republic of Uzbekistan. No permit is required for the extraction of wild animals raised in nurseries or pond farms and located on their territory.
The following amendments have been made to the second and third parts of Article 32 of the Law "On Hunting and Hunting Economy":
— The right to conduct hunting farming arises from the date of signing by legal entities or individuals of an agreement on the provision of hunting grounds with the Forestry Agency under the Ministry of Ecology, Environmental Protection, and Climate Change of the Republic of Uzbekistan, if the hunting grounds are located on the lands of the forest fund, or the Ministry of Ecology, Environmental Protection, and Climate Change of the Republic of Uzbekistan, if the hunting grounds are located on lands that are not part of the forest fund.
— Hunting management by public associations of hunters is carried out on the basis of a feasibility study and an agreement on the provision of hunting grounds with the Forestry Agency under the Ministry of Ecology, Environmental Protection, and Climate Change of the Republic of Uzbekistan if the hunting grounds are located on the sites of the state forest fund or the Ministry of Ecology, Environmental Protection, and Climate Change of the Republic of Uzbekistan if the hunting grounds are located in areas that are not part of the state forest fund.
The following amendments were also made to the Law:
— The forced removal from the natural environment of animals affected by natural, man-made, and anthropogenic factors for the purpose of rehabilitation and subsequent release into nature is carried out in special agreement with the Ministry of Ecology, Environmental Protection, and Climate Change of the Republic of Uzbekistan without payment for extraction.
– The use of animals raised in nurseries, including those listed in the Red Book of the Republic of Uzbekistan (third generation and subsequent), for training hunting birds of prey is allowed if there is a permit for the extraction of wild animals, with prior provision to the Ministry of Ecology, Environmental Protection, and Climate Change of the Republic of Uzbekistan of information on the number and types of animals used, the place and time of the training, the list of identification numbers of rings, microchips, and other identifying signs.
– The list of pests of forestry, agriculture, and hunting, vectors of dangerous human and animal diseases, is approved by the Ministry of Ecology, Environmental Protection, and Climate Change of the Republic of Uzbekistan in coordination with the Academy of Sciences of the Republic of Uzbekistan, the Ministry of Health of the Republic of Uzbekistan, the Ministry of Agriculture of the Republic of Uzbekistan, and the State Committee of Veterinary Medicine and Livestock Development under the Ministry of Agriculture of the Republic of Uzbekistan, by public associations of hunters.
This Law is aimed at ensuring the effective organization of public administration in the field of ecology, increasing the number of rare and endangered species of wild plants and wild animals listed in the Red Book of the Republic of Uzbekistan, improving the conditions of their growth and habitat, as well as ensuring uniform law enforcement practice in the field of public services.
