Housing and Rental Matters
Concluding a Residential Lease Agreement
Under a lease of a building or structure, the landlord undertakes to transfer it to the tenant for temporary possession and use, or temporary use.
A residential lease must be in writing and does not require notarization. The lease term is up to five years.
At the request of the tenant and family members, the agreement may be concluded with one family member. If the tenant dies or moves out, the agreement is concluded with a family member who lives in the property.
The agreement must identify the people who permanently reside with the tenant.
No fee is charged for registering real-estate agreements with the state tax authorities. Registration is free through ijara.soliq.uz. Failure to register an agreement with the tax authorities entails a fine.
The absence of a lease or a free-use agreement between individuals for a building, structure, part thereof or dwelling, or failure to comply with mandatory tax registration of a lease, entails a fine of five to ten base calculation units.
Landlord’s Responsibilities
The landlord must provide vacant housing suitable for permanent residence.
The landlord must ensure proper operation of the building, provide necessary utilities for a fee or arrange their provision, ensure repairs to common property in an apartment building and utility equipment in the residential building, and take measures to ensure the housing is used only for the purposes stated in the lease.
