State Governance System and Activities of the District Hokimiyat
In the Republic of Uzbekistan, state governance is carried out by three branches of power: legislative, executive, and judicial.
The legislative branch is represented by the Oliy Majlis, which consists of two chambers — the lower and the upper chambers. The lower chamber, known as the Legislative Chamber, is composed of 150 deputies who work on a permanent basis and are primarily engaged in drafting and adopting legislation. The upper chamber is called the Senate and consists of 100 senators. Senators, without leaving their main professional activities, convene periodically to review and approve laws adopted by the Legislative Chamber.
The executive branch includes the Cabinet of Ministers, ministries and agencies, as well as the hokimiyats of the city of Tashkent and the regions. In simple terms, the executive branch ensures the implementation of laws at the local level.
The judicial branch consists of the Supreme Court of the Republic of Uzbekistan and all courts operating in various fields. The courts ensure compliance with the law by both executive authorities and citizens.
The district hokimiyat ensures the socio-economic development of the district and the implementation within the territory of the district of the laws of the Republic of Uzbekistan, resolutions of the Oliy Majlis, decrees, resolutions, and orders of the President of the Republic of Uzbekistan, resolutions of the Cabinet of Ministers, as well as decisions, orders, minutes, and instructions of the regional hokim and the Regional Council of People’s Deputies.
In its activities, the district hokimiyat is accountable to the President of the Republic of Uzbekistan, the Cabinet of Ministers, and the District Council of People’s Deputies.
The implementation of the powers of the district hokimiyat is ensured through the activities of the district hokim, deputy hokims, heads of local state administration bodies, permanent and temporary commissions of the district hokimiyat, other working bodies established by relevant decisions, as well as the administrative apparatus of the district hokimiyat.
The activities of the district hokimiyat are organized by the district hokim. Within the scope of powers established by law, the district hokim adopts decisions that are mandatory for execution by all bodies, enterprises, organizations, officials, and citizens within the territory of the district. Normative or documents of significant importance issued by the district hokim are adopted in the form of resolutions, while documents on operational and other current issues are adopted in the form of orders.
In accordance with the Resolution of the President of the Republic of Uzbekistan dated November 28, 2017, No. PQ–3407 “On Measures to Improve the Activities of Local Executive Authorities in Attracting Investments and Introducing Innovations,” the tasks, functions, rights, responsibilities, and the procedure for organizing the activities of the administrative apparatus of the district hokimiyat are determined.
In its activities, the administrative apparatus is guided by the Constitution of the Republic of Uzbekistan, the Law of the Republic of Uzbekistan “On Local State Authority,” other laws of the Republic of Uzbekistan, resolutions of the chambers of the Oliy Majlis, decrees, resolutions, and orders of the President of the Republic of Uzbekistan, resolutions and orders of the Cabinet of Ministers, decisions and orders of the regional hokim, as well as other legislative acts, documents of the Council of People’s Deputies and the hokim, and the Regulation on the Administrative Apparatus of the Hokimiyat of Namangan Region, Turaqo‘rg‘on District.
The administrative apparatus provides information-analytical, legal, organizational-technical, and financial-economic support for the activities of the hokimiyat, prepares sessions of the Council of People’s Deputies in accordance with its regulations, drafts documents of the Council of People’s Deputies and the hokim, develops practical measures for their implementation, and regularly monitors their execution.
The administrative apparatus also ensures organizational, technical, and other support for the activities of the Council of People’s Deputies.
In its activities, the apparatus of the district hokimiyat is guided by the Constitution of the Republic of Uzbekistan, the Law of the Republic of Uzbekistan “On Local State Authority,” the Resolution of the President of the Republic of Uzbekistan dated November 28, 2017, No. PQ–3407, the Resolution of the Cabinet of Ministers dated March 29, 1999, No. 140, which approved the “Instruction on the Organization of Records Management and Control over the Execution of Documents in the Apparatuses of the Council of Ministers of the Republic of Karakalpakstan, Hokimiyats of Regions, Cities, and Districts of the Republic of Uzbekistan,” as well as the regulations of the regional hokimiyat.
The handling of proposals, applications, and complaints from citizens is carried out in accordance with the Law of the Republic of Uzbekistan “On Appeals of Individuals and Legal Entities.”
