The Law is aimed at further improving documentation in the field of migration and employment, as well as increasing the transparency and effectiveness of the activities of private employment agencies.
Legislation in the field of migration and employment has been further improved. According to it, the powers of the Migration Agency have been clarified, and the rights and obligations of private employment agencies have been expanded.
According to the new procedure, cases of violation of the Law on Private Employment Agencies will be considered by the Migration Agency. Article 501 of the Code of Administrative Offenses For this purpose, Article 2551 was added to the Code of Administrative Offenses.
The right to impose an administrative fine is granted to the director of the Migration Agency and his deputies.
According to the amendments to the Law "On Private Employment Agencies", private employment agencies have new rights and obligations. Now agencies have the right to organize vocational training and foreign language courses for job seekers and attract foreign employers.
New obligations
The activities of private employment agencies serving citizens seeking work abroad will now be carried out on the basis of enhanced financial guarantees.
Before starting their activities, private employment agencies are obliged to: place funds in the amount of 4,000 times the base calculation amount in a special deposit account in a commercial bank until the license expires.
This amount cannot be spent without the consent of the Migration Agency. If the funds were spent, they will be required to be fully restored within the timeframe set by the Private Employment Agency.
These funds are a guarantee of the activities of the Private Employment Agency.
The funds placed in the deposit are a financial guarantee of the full compliance of the private employment agency with the requirements of the law, as well as a source of compensation for losses that may be caused to citizens as a result of its activities.
These funds are stored on the basis of a special agreement concluded between the bank, the Migration Agency, and the agency itself.
Procedure for transferring funds to the Migration Fund
If a private employment agency is found to have violated the law or harmed the interests of citizens: The Migration Agency submits a reasoned request; In this case. The Agency is obligated to transfer funds from the bank deposit to the Migration Fund. If the application is not fulfilled voluntarily, the commercial bank: withdraws the amount specified in the application from the deposit and transfers it to the Migration Fund no later than the next business day.
This mechanism: protects the rights of citizens;
Increases the responsibility of private employment agencies;
reduces risks associated with citizens engaged in temporary labor activity abroad;
ensures transparency in the service sector.
Also, the agencies are obliged to monitor the labor activity of citizens sent abroad if there are problems with working conditions or salary, they must quickly find a new employer or organize the return of the citizen to Uzbekistan. Expenses for the return of citizens are covered by the Agency's reserve funds.
These changes are aimed at ensuring the safety of labor migration, increasing the responsibility of agencies, and strengthening the protection of citizens' rights.
