The issues raised in the critical article titled “Human Life Is Above Any Economic Interest. Has the Safety of the Amusement Rides Been Ensured?”, published on June 5 of this year by the “Effect.uz” news agency, were thoroughly and comprehensively examined under the supervision of the Fergana District Hokimiyat, with the involvement of authorized state supervisory bodies.

In response to public concerns and the media’s inquiry regarding the enforcement of the rule of law, an interagency working group was established, comprising specialists from the Fergana Territorial Department of the Committee for Industrial, Radiation and Nuclear Safety, the Fergana District Department of Emergency Situations, and the District Department of Construction and Housing and Communal Services.

The working group conducted a comprehensive on-site inspection of the recreational facility to assess compliance with technical safety requirements and urban planning legislation.

As a result of the inspection, the following systemic violations were identified in the operation of 22 amusement rides of various types. These violations pose a direct threat to the life and health of citizens, particularly minors, and constitute serious breaches of current legislation.

1. Violations of Urban Planning Legislation and Architectural Standards

• According to the conclusion of the District Department of Construction and Housing and Communal Services, citizen Umidjon Shukurjon o‘g‘li Yusrunov carried out activities on a non-residential land plot located on Satkak Street in violation of applicable urban planning norms and regulations.

• The citizen bypassed the requirements of the Regulation approved by Resolution No. 200 of the Cabinet of Ministers of the Republic of Uzbekistan dated April 20, 2022, and, without obtaining the necessary permits in accordance with established procedures, arbitrarily constructed concrete foundations and installed a metal-structured amusement ride.

2. Non-Compliance with Industrial and Technical Safety Requirements

• None of the amusement rides operating within the recreational facility had obtained the mandatory permits for safe operation as required by Resolution No. 566 of the Cabinet of Ministers of the Republic of Uzbekistan dated October 5, 2022.

• In violation of technical regulations, several amusement rides (including the “Russian Boat,” “Slide,” “Chain Ride,” and “Train”) had not undergone mandatory static and dynamic technical testing. No laboratory reports issued by accredited specialized organizations confirming the structural integrity of their metal constructions and steel components were provided.

• The qualification level of operators and responsible personnel servicing the rides does not meet established requirements. Certificates confirming completion of specialized training courses have either expired or are entirely absent. Daily technical inspection logs were not maintained.

3. Violations of Fire and Electrical Safety Regulations

• The facility lacked evacuation plans for people and emergency rescue schemes for property in the event of emergencies, as well as action plans for urgent response measures. Access routes for fire and rescue vehicles were not properly arranged, and fire safety boards were not installed.

• Electrical distribution panels and high-voltage cables do not comply with operational requirements. The electrical system has not undergone laboratory testing, was installed using temporary and improvised methods, and the doors of distribution boxes were left open and without warning signs. The facility also lacked first-aid kits.

Strict Legal and Administrative Measures Taken

In accordance with the Constitution of the Republic of Uzbekistan, human life, health, and safety are the highest values and take precedence over any economic interest, investment project, or business income.

Based on this principle, the working group implemented the following enforcement measures:

1. Administrative Liability

In accordance with Resolution No. 192 of the Cabinet of Ministers of the Republic of Uzbekistan dated March 28, 2025, all official documents related to the identified urban planning violations committed by U. Yusrunov were submitted to the State Architecture Department under the Ministry of Construction and Housing and Communal Services of the Republic of Uzbekistan for administrative proceedings under Paragraph 8 of Article 99 of the Code of Administrative Responsibility of the Republic of Uzbekistan (Violation of Urban Planning Legislation).

2. Suspension of Operations

The operation of all 22 amusement rides at the “Satkak” summer recreational facility has been completely suspended until all identified deficiencies are fully eliminated and the required legal permits are obtained. All equipment at the facility has been disconnected from the power supply network.

3. Mandatory Dismantling

Two “Zipline” installations that were found to be entirely non-compliant with applicable technical standards and posed a real threat to public safety were fully dismantled and removed from the site.

The Fergana District Hokimiyat reiterates the inviolability of state policy aimed at ensuring the rule of law and protecting the rights and legitimate interests of citizens. Systematic inspection and monitoring activities covering all parks, recreational facilities, and entertainment venues within the district will continue.
