Official Statement of the Fergana District Khokimiyat Regarding the Appeal Circulated in mass media and social networks

Following a video appeal circulated in mass media and social networks under the message “Residents of Fergana have not received wages for work performed in summer even during winter,” the Fergana District Khokimiyat conducted an official review in accordance with established procedures.
The appeal was examined with the participation of representatives of the Fergana District Khokimiyat, the State Labor Rights Inspector of the Department for Poverty Reduction and Employment Support, as well as a specialist from the People’s Reception Office of the President of the Republic of Uzbekistan in Fergana District. The review was carried out in compliance with Article 24 of the Law of the Republic of Uzbekistan “On Appeals of Individuals and Legal Entities” and the Law “On Employment of the Population” dated October 20, 2020, No. ZRU–642.
The review revealed that during the summer period, labor relations were formed between the citizens and “Fergana-Oseana” Limited Liability Company based on an oral agreement for clearing agricultural fields of weeds. The work was carried out under the supervision of local agronomists. However, upon completion of the seasonal work, wages were not fully paid, and in some cases, settlements were not made at all by the employer.
At the same time, it should be emphasized that district (city) khokimiyats do not have the authority to issue court decisions or apply coercive measures in labor or commercial disputes. The main responsibilities of khokimiyats include ensuring socio-economic development of the territory, compliance with legislation, and lawful consideration of citizens’ appeals. Contractual and labor disputes between citizens and business entities are resolved by judicial authorities in accordance with the law. Courts are independent bodies, and executive authorities do not interfere in judicial proceedings.
Taking into account that the outstanding wages were not paid within the periods specified in the appeal by the current director of “Fergana-Oseana” LLC, Abdurazzoq Mamanabiyev, the Fergana District Prosecutor’s Office and the State Labor Rights Inspector are preparing the necessary documentation to file a claim with the Fergana Inter-District Civil Court in accordance with Articles 181–182 of the Civil Procedural Code and Article 253 of the Labor Code of the Republic of Uzbekistan.
In addition, the Fergana District Khokimiyat plans to organize meetings with the disputing parties, conduct explanatory work, and promote the use of mediation mechanisms in cooperation with justice and legal authorities. If citizens or entrepreneurs are dissatisfied with the activities of state services, the khokimiyat provides legal guidance and practical assistance in applying to other competent authorities.
The Fergana District Khokimiyat declares that, in cooperation with authorized bodies, all necessary measures will be taken to ensure that this issue is resolved within the framework of the law, based on the principles of justice and transparency.
