The Mining and Geology Control Inspectorate to recover penalties from a contractor for failure to fulfill contractual obligations

On December 10, 2025, a contract for the supply of goods No. 39*** was signed between the Inspectorate and "F." LLC through a special information portal. According to the contract, the entrepreneur undertook the obligation to deliver an unmanned aerial vehicle (DJI Matrice 400 drone and its components) for a total amount of 520,000,000 UZS. Although the Inspectorate made the payment in full, the goods were not delivered within the specified 20 working days.
As the dispute was not settled out of court and the demand letter dated April 7, 2026, remained unanswered, the Inspectorate recovered the previously transferred funds of 520,000,000 UZS. However, the refund of the payment does not exempt the supplier from liability for each day of delay. Due to the non-fulfillment of obligations for 91 days, a penalty of 236,600,000 UZS was calculated based on clause 4.3 of the contract and Article 25 of the Law of the Republic of Uzbekistan "On the Contractual and Legal Framework of the Activities of Economic Entities."
The Tashkent Inter-District Economic Court partially satisfied the plaintiff's claim and issued a decision to recover a penalty of 50,000,000 UZS and court costs. Such strict measures serve to increase the responsibility of business entities toward state orders. The functioning of the control system in this manner prevents cases of breach of contractual discipline and serves as an effective mechanism for the legal protection of state interests.
