During monitoring activities, specialists from the Inspectorate for Control in the Mining Industry and Geology under the Ministry of Mining Industry and Geology recorded serious legal violations at the site. Specifically, at the "Qaqir 8" deposit, 24,841 cubic meters were extracted below the specified depth, and 69,038.63 cubic meters were mined outside the boundaries of the assigned area. As a result of these illegal actions, a total damage of 2,634,919,575 soums was caused to state interests in an especially large amount.
The court found the defendant, Kh. Kh., guilty of committing the crime stipulated under Article 229 of the Criminal Code of the Republic of Uzbekistan. He was sentenced to a fine of 20 times the base calculated amount, totaling 7,500,000 soums. Furthermore, taking into account the sentence from a previous court ruling, he was sentenced to 3 years of imprisonment, which, according to Article 72 of the Criminal Code, was made conditional with a 2-year probation period. To recover the remaining damage of 97,142,238 soums, a "SINOTURK HOWO" truck belonging to the perpetrator was seized.
This court decision once again demonstrated the strict enforcement of the rule of law in the field of subsurface resource use. Regular monitoring and surveying measurements by regulatory authorities are key factors in preventing illegal mining activities. Ensuring legality serves not only environmental protection but also the preservation of state budget funds and the creation of a fair economic competition environment.
