Sentence Passed for Illegal Use of Subsoil: Over 914 Million Soums in Damage Caused to the State

This fact was revealed during control measures conducted by the Inspectorate for Control in the Mining Industry and Geology. During the investigation and trial, it was established that citizen B.A., who served as the head of "G.M.B." LLC and the founder of "V." LLC, operated within the "Eyvalek-6" deposit area and adjacent territories of the Akhangaran district during 2020–2024 without obtaining a license in the prescribed manner.
The defendant B.A., abusing his official powers, expanded beyond the deposit boundaries and went below the established depth, illegally extracting a total of 76,500.16 cubic meters of loess rocks. He aimed to gain significant profit by producing and selling fired bricks at his factory using this raw material.
As a result of measurements conducted by specialists from the regulatory body and the surveying service, it was confirmed that the economic damage caused to the subsoil amounted to 914,176,912 soums. This damage amount is based on the conclusion of a forensic commodity expertise regarding the average market price of the soil (11,950 soums per cubic meter).
During the trial, the accused pleaded fully guilty, explaining his illegal actions as a desire to settle debt obligations. He also stated that he had fully compensated for the damage caused, expressed remorse for his actions, and asked the court for leniency.
The Akhangaran District Criminal Court found B.A. guilty under Article 192-11, Part 2, Clause "a" (Abuse of power by officials of a non-governmental commercial or other non-governmental organization) and Article 229 (Self-governance/Arbitrariness) of the Criminal Code of the Republic of Uzbekistan. It was determined to recover the damage amount of 914,176,912 soums in favor of the state.
This case demonstrates that the work of state regulatory bodies to ensure legality in the field of subsoil use continues on a strict basis. Illegal excavations not only damage the state economy but also lead to the disorderly consumption of natural resources and the disruption of ecological balance.
