On August 19 of this year, the Legislative Chamber of the Oliy Majlis adopted in the second and third readings the draft Law of the Republic of Uzbekistan “On Compensation for Damage Caused by an Illegal Decision or Action (Inaction) of a State Body or Its Official” and sent it to the Senate.

✅ The draft law provides for the following:
➖ compensation in monetary form for damage caused to an individual or legal entity as a result of an unlawful decision or action (inaction) of state bodies, organizations, or their officials during the course of their activities;
➖ formation of territorial target funds to compensate for damages and the sources of their financing;
➖ court rulings and writs of execution regarding compensation for damages shall be sent to the state bailiff and the legal service of the local khokimiyat at the place of residence of the debtor, without the interference of human factors;
➖ periodic reporting to the Cabinet of Ministers, the Jokargy Kenes of the Republic of Karakalpakstan, and local councils regarding the use of funds.

✅ With the adoption of the law, the constitutional right of citizens to compensation by the state for damage caused by unlawful activities of state bodies or their officials will be ensured. In addition, legal grounds will be established for recovering such amounts in regress order from guilty officials. Adoption of this draft law will contribute to restoring the violated rights of citizens and entrepreneurs, increasing the personal responsibility of officials, and ensuring transparency in the activities of state bodies.
