Inspection for control in the field of mining industry and geology under the Ministry of Mining Industry and Geology of the Republic of Uzbekistan

The Oltinkol District Criminal Court reviewed an administrative case concerning M.M., the head of "A.T.M.Q." LLC, under Part 1 of Article 70² of the Code of the Republic of Uzbekistan on Administrative Responsibility. According to the court ruling, the offender who extracted a sand and gravel mixture without the necessary permits was subjected to an administrative fine and ordered to pay material damages to the state body.

This ruling holds significant importance in ensuring compliance with subsoil use regulations within the mining industry and geology, as well as preventing illegal extraction practices.

It was established that M.M., head of "A.T.M.Q." LLC, operated on reserve land plots of Oltinkol District located in Andijan District without the authorization of competent organizations and required permits. In violation of the Land Code of the Republic of Uzbekistan and the Law "On Subsoil", he illegally extracted a total of 4,720 m³ of sand and gravel mixture valued at 47,672,000 UZS.

This administrative violation was identified during control inspections conducted by the Inspectorate for Control in Mining Industry and Geology, and was documented in accordance with the established procedure.

During the court hearing, the offender M.M. fully admitted his guilt and expressed remorse for his actions. His guilt was further corroborated by the protocol, written explanation, and a collection of other written evidence present in the case file.

Having evaluated the compiled evidence legally, the court found M.M. guilty of committing the violation stipulated in Part 1 of Article 70² of the Code on Administrative Responsibility. He was sentenced to an administrative fine equal to 40 times the base calculation amount, totaling 13,200,000 UZS.

Furthermore, the court ordered the recovery of material damage amounting to 47,672,000 UZS caused by the offense in favor of the Inspectorate for Control in Mining Industry and Geology. To ensure the execution of the decision, an execution writ was forwarded to the Bureau of Compulsory Enforcement.

This judicial decision demonstrates a firm stance on enforcing legality and discipline in the field of subsoil management. Natural resources are protected by the state, and their unauthorized, unregulated exploitation inflicts severe harm on both the environment and the national economy.

The effective execution of state control within the mining and geological sectors allows for the timely prevention of illegal extraction activities and the full recovery of inflicted damages. This underscores the imperative for all subsoil users and business entities to strictly adhere to legislative requirements.
